Terms of Service
Last updated: August 13, 2010
Thanks for visiting WLA. Our website – www.TheWLA.org (the “Website”) – is designed to bring you information about legal resources available to artists. While these Terms of Service (the “Terms”) may seem boring, they explain how you can use our Website and are a legal agreement between you and Washington Lawyers for the Arts (“WLA” or “we”). These Terms also allow us to provide you with valuable information, so please read these Terms carefully. If you visit our Website, you agree to follow the rules explained here. If you don’t agree with these Terms, then unfortunately you cannot use our Website.
Permission to Use our Website
Sorry kids, our Website is not intended for those under the age of 13, and you must be 13 years of age or older to use our Website.
Subject to these Terms, we grant to you a limited license to use our Website for your personal use and not for resale or further distribution. If you like our content, and want to share it, just ask us! Email info@thewla.org.
Prohibited Uses
Please play by the rules. Except as otherwise explicitly provided in these Terms or as may be expressly permitted by applicable law, you will not, and will not permit or authorize any third party to: (i) reproduce, modify, translate, enhance, decompile, disassemble, reverse engineer or create derivative works of any content from our Website; (ii) rent, lease or sublicense access to any portion of our Website; (iii) circumvent or disable any security or technological features or measures of our Website; (iv) access, monitor, or copy any content or information on the Website using any robot, spider, scraper, or other automated means or any manual process for any purpose without our express written permission; or (v) "frame", "mirror," or otherwise incorporate any part of the Website into any other website without our prior written authorization.
Disclaimer
We provide legal clinics and legal arts workshops. We, however, are not your lawyer and cannot guarantee that we will find you a volunteer attorney. The materials on our Website are for informational purposes only and do not constitute advertising, a solicitation, or legal advice. Our Website is not intended to create and does not constitute the formation of an attorney-client relationship. Please do not rely upon this information for any purpose without seeking legal advice from a licensed attorney. Also, since we are not your lawyer, please don’t send us confidential or sensitive information because it will not be treated as privileged or confidential.
Ownership
We, our affiliates, and our licensors own all right, title, and interest, including all intellectual property rights, in and to the Website. Our Website is protected by applicable intellectual property laws, including United States copyright law and international treaties. (Want to know more about these laws? Visit our clinics and legal arts workshops!) Except for those rights expressly granted in these Terms, no other rights are granted, either express or implied, to you.
Third-Party Content
To be helpful to you, the Website contains links to webpages and content of third parties ("Third-Party Content") as a service to those interested in this information. But please remember that we do not monitor, endorse, review, or adopt, or have any control over, any Third-Party Content. Be smart, we cannot promise the stuff we link to is accurate or up to date.
Additionally, if you follow a link or otherwise navigate away from the Website, please be aware that these Terms will no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any Third-Party Content provider to which you navigate from the Website. You access and use Third-Party Content at your own risk.
Feedback
We love to hear from you! Contact us anytime. But remember, any materials, including but not limited to comments, suggestions, ideas, or other information, provided by you in the form of email or other submissions to us (collectively “Feedback”), are non-confidential and you hereby grant us a perpetual and irrevocable license to use your Feedback for any purpose without compensation or attribution to you.
Privacy Policy
If you provide us with any personally identifiable information via email or other means, we may use it to provide services and information that you request; to enhance, improve, operate, and maintain the Website and our other systems; and to maintain a record of our dealings with you, and for other administrative purposes.
Indemnification
You agree to defend, indemnify and hold harmless WLA and its licensors from and against any and all claims, proceedings, injuries, liabilities, losses, costs and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Website.
Disclaimer of Warranties
Your use of our Website is at your sole risk. WLA and its licensors disclaim any and all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement. You understand and agree that our Website and all content available on and through our Website are provided “as is.” WLA does not warrant uninterrupted use or operation of the Website or your access to any content. No advice or information, whether oral or written, obtained by you from our Website will create any warranty regarding WLA that is not expressly stated in these Terms. Because some jurisdictions do not permit the exclusion of implied warranties, portions of this section may not apply to you.
Limitation of Liability
Neither WLA nor its licensors, will be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if WLA or any licensor has been advised of the possibility of these damages), resulting from your access or use of the Website. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. The maximum total liability of WLA and its licensors for any claim under this Agreement, whether in contract, tort, or otherwise, is $100. The limitations described in this Limitation of Liability section will apply even if any limited remedy under this Agreement fails of its essential purpose.
Modifications to the Website
Notwithstanding any provision of these Terms, WLA reserves the right, without notice and in our sole discretion, to terminate your license to use the Website and to block, restrict, and prevent your future access to, and use of, the Website. Additionally, WLA reserves the right to modify, discontinue, and restrict, temporarily or permanently, all or part of the Website without notice in our sole discretion. Neither WLA nor our licensors will be liable to you or to any third party for any modification, discontinuance, or restriction of the Website.
Updates
Since this is our Website, we may make changes to these Terms. By accessing or using the Website, you accept these Terms and any modifications that we make to them. When we change these Terms, we will let you know by updating the “Last Updated” date above. By continuing to use the Website, you consent to any updates to these Terms.
General Legal Notices
Here is the legal mumbo jumbo. Our failure to act in a particular circumstance does not waive our ability to act with respect to that circumstance or similar circumstances. Each of the provisions of these Terms is severable and independent of all other provisions of these Terms. These Terms are governed by the laws of the State of Washington, excluding conflicts of law principles, and any claim against WLA must be commenced within one year after the claim arose. You irrevocably consent to the exclusive personal and subject matter jurisdiction of the federal, state and local courts located in Seattle, Washington.
